Vari-Wall Bicycle Building Customers

Thank you for purchasing from Vari-Wall!  Vari-Wall Bicycles, Inc. (“Vari-Wall”) is a privately-held company headquartered in Columbiana, Ohio.

We specialize in the manufacture of high strength, light weight variable wall thickness tubular components for critical applications. Our customers are some of the world’s best bicycle designers and builders.  Our tubing is available in sizes ranging from .750” OD to 1.750” OD and gauges ranging from ultra-light 7/4/7 through constant wall 1.2mm, having strength levels ranging from 150 to 200 ksi.  Our unique manufacturing process is engineered to meet our customers’ specific and unique needs for light-weight tubing. RECOMMENDATIONS TO BUILDERS.Vari-Wall encourages all bicycle builders to have their frame weld-joints tested after welding/brazing.  The testing should be done by an accredited lab capable of running tests in accordance to ISO standards.  Among others, Specialize Testing, Inc., in Santa Fe Springs, CA is an ISO/IEC accredited lab specializing in materials testing, including strength and fatigue testing. If you are a novice bicycle builder and would like to receive formal bicycle welding/brazing training, you can reach out to mechanics school with bicycle building training, including the United Bicycle Institute (“UBI”) located in Ashland, OR at (541) 488-1121. UBI offers several frame building courses designed to provide you with a foundation in bicycle building techniques and standards.

DISCLAIMER OF WARRANTIES.VARI-WALL IS A MANUFACTURER OF specialty TUBING, including butted tubing for bicycles.  Vari-Wall IS NOT A DESIGNER, SUPPLIER, builder, OR DEALER OFBICYCLES. THEREFORE, VARI-WALL MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO THE DESIGN OR CONDITION OF ANY BICYCLE BUILT USING OUR TUBING, ITS MERCHANTABILITY, ITS SAFETY, ITS CAPACITY, ITS PERFORMANCE, ITS WORKMANSHIP, ITS FITNESS FOR ANY PARTICULAR PURPOSE, OR THAT IT WILL MEET THE REQUIREMENTS OF ANY LAWS, RULES, SPECIFICATIONS, OR CONTRACTS WHICH PROVIDE FOR SPECIFIC bicycle DESIGN and building STANDARDS OR SPECIFICATIONS. VARI-WALL FURTHER DISCLAIMS ANY LIABILITY WHATSOEVER FOR LOSS, DAMAGE, OR INJURY AS A RESULT OF design or manufacturing DEFECTS of our customer’s bicycle, LATENT OR OTHERWISE, USING OUR TUBING. To be clear, VARI-WALL SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, DELAY, OR DAMAGE OF ANY KIND OR CHARACTER RESULTING FROM NEGLIGENCE, DEFECTive DESIGNS, failure to warn,weak WELDS, OR ACCIDENTAL BREAKAGE of a bicycle as a result of the bicycle builder.

RISK OF LOSS AND INJURY; INDEMNIFICATION.Vari-Wall encourages each customer to obtain appropriate manufacturing insurance against risk of loss and injury caused by defective design, failure to warn, weld breakage, and/or inferior manufacture using Vari-Wall tubing.  Vari-Wall shall not be responsible for any injury and loss or damage to property or equipment belonging to our customer, its agents, employees, or the end-users of any bicycle built using our tubing once our tubing is in your care, custody, or control.  Our customer shall indemnify, defend and hold harmless Vari-Wall and its officers, directors, agents and employees from and against claims, damages, losses and expenses, including but not limited to attorneys’ fees, arising out of or resulting from negligence, product liability, and/or failure to warn, in connection the build bicycle.

INSPECTION: CONCLUSIVE PRESUMPTIONS.All Vari-Wall customers shall inspect our tubing within ten (10) business days after delivery. Unless the customer within said period of time gives written notice to Vari-Wall, specifying any defect in or other proper objection to our tubing, the customer agrees that it shall be conclusively presumed that the tubing has been carefully inspected by the customer, and the customer acknowledges that the tubing is in full compliance with requirements, in good condition, and that you are satisfied with and have accepted the tubing in such good condition.
